The gunman, identified by police as 29-year-old Tom Latanowich of Somerville, was captured after a standoff with police and charged with murder.  He's being held without bail.

Gannon died. Nero spent the night at a veterinary specialist and had surgery Friday.

"K9 Nero has survived emergency surgery and is being treated and taken care of by the best medical staff in New England at a location here on Cape Cod," Yarmouth Police posted on Facebook in a message thanking everyone for their support.

"Nero is under full 24/7 Law Enforcement protection and will remain in the care and control of the Yarmouth Police Department K9 Unit and K9 Units all across New England."

Peter McClelland, a retired Yarmouth Police officer who trained Nero, has been at the dog's side ever since he was shot and is providing comfort. McClelland says Nero is "stable, but not out of the woods."
