Report: Tom Brady Wants To Appeal Second Circuit's Decision

BOSTON (CBS) -- When news broke Monday morning that the Second Circuit Court of Appeals ruled to reinstate the four-game suspension on Tom Brady, nobody knew what would come next.

A new report provides the answer.

The Boston Herald's Jeff Howe reported that Brady is "angry" and plans to appeal the court's ruling.

"He plans to exhaust all of his options to continue this battle with the league and win his innocence," Howe reported. "[B]arring an unforeseen dose of advice from his legal team that causes a drastic about-face, Brady has no intention to quit."

Later Monday night, Scott Zolak from 98.5 The Sports Hub tweeted that Brady is interested in fighting the ruling. "Source close to TB12, dig in....going to the wall," the former Patriots quarterback tweeted.

It's not entirely surprising. After all, Brady was successful in his first appeal, which was ruled on in federal court by Judge Richard Berman. And the dissenting opinion by Chief Judge Robert Katzmann of the Second Circuit provides some hope for Brady and the NFLPA that other judges could see the case differently from judges Denny Chin and Barrington Parker Jr.

Michael McCann, an attorney and professor, was at the hearing in New York last month. "Brady is coming from behind at this point," McCann told WBZ-TV's Julie Loncich.

Brady has several options - he can appeal to the entire Second Circuit, he can ask the Supreme Court to hear his case or there's a slim chance he and Goodell might settle.

"I think he will fight it," McCann says. "I think he knows the odds are low, but I also think he realizes that his legacy is, in part, on the line."
