The new judge assigned to preside at the trial of gangster James “Whitey” Bulger has scheduled a status conference in the case for next week.
A federal appeals court has agreed to a defense request to remove the judge who was set to preside over the trial of accused gangster James “Whitey” Bulger.
Federal prosecutors say there’s no proof the judge overseeing gangster James “Whitey” Bulger’s trial is biased. Bulger’s attorneys say U.S. District Court Judge Richard Stearns has a conflict of interest because he was a federal prosecutor in the 1980s, when Bulger was an FBI informant. They say Stearns would have known about an agreement for immunity from his crimes that Bulger says he had with the FBI.
Whitey Bulger’s lawyer says Judge Stearns should recuse himself because “a person can not be both judge and witness.”
The trial for Whitey Bulger will be now take place on March 4, 2013.
