Owen Labrie To Be Released On Bail Pending Appeal

CONCORD, N.H. (CBS/AP) — A New Hampshire prep school graduate convicted of sexually assaulting a 15-year-old freshman girl as part of a game of sexual conquest called Senior Salute will again be free pending appeal.

Tunbridge, Vermont, native Owen Labrie had been free after his conviction last year. A judge revoked his bail in March after he admitted violating curfew. He appealed to the state Supreme Court, which returned the matter to the trial court.

Labrie's attorney argued at a Monday hearing being locked up for two months has been "life-changing" for him and he'll comply with any additional conditions.

"While it may not seem significant to say that somebody spent two months in incarceration for someone who has never been incarcerated for one hour, two months can be a very long time," says defense attorney Jaye Rancourt.

Prosecutor Catherine Ruffle countered, saying, "The only thing that's changed is (Labrie) doesn't like it in jail."

A Merrimack County Superior Court judge says he'll allow Labrie to be released with electronic monitoring with GPS.

He is expected to be released on Wednesday.

Labrie graduated from St. Paul's School in Concord.
