Crash Victims' Attorney: Brandon Spikes' Actions 'Inexplicable'

BOSTON (CBS) – An attorney for the Billerica family that was rear-ended by the sports car allegedly driven by former Patriots linebacker Brandon Spikes called the incident "inexplicable."

Marc Breakstone said it was "perplexing, astounding and inexplicable" that Spikes did not stop after police say he rear-ended an SUV with a Billerica couple and their 12-year-old son inside.

State police on Friday said Spikes will be cited for leaving the scene of a personal injury crash, operating a motor vehicle negligently to endanger, speeding and failure to stay within marked lanes.

The charges stem from a Sunday crash on I-495 in Foxboro. Police say Spikes was driving at a high rate of speed when he hit the Billerica family's SUV.

Spikes claimed he hit a deer, but police did not find a deer in the area.

"There was never a question in our mind that his vehicle was responsible for the crash that injured my clients. The question remains why he would flee the scene. That remains to be answered," Breakstone told WBZ-TV.

Breakstone said he will file a claim against Spikes' insurance. The attorney declined comment on what the accident says about the former Patriots player's character.

Spikes was released by the Patriots on Monday.

According to Breakstone, the Billerica family remains shaken up nearly a week after the crash.

"They're happy to be intact and to not have been injured worse. They look forward to seeing the justice process completed," Breakstone said.

"The family is distressed that someone could drive at such a high rate of speed that could have killed them. The family is disgusted that the individual responsible for this crash could have then fled the scene. It's just inexplicable."
