Dorchester Shooting Victim's Dad Concerned Over Supreme Court Ruling

DORCHESTER (CBS/AP) - The father of a 14-year-old boy killed two years ago in Dorchester is not pleased with the Supreme Court decision that rejects the sentencing of juveniles to life without parole.

Nathaniel Davis Jr.'s son Nicholas Fomby-Davis was shot and killed at point-blank range in 2010 by 16-year-old Joshua Fernandes.

Fernandes and Crisostomo Lopes were both recently sentenced to life behind bars without the possibility for parole, but Davis is concerned they will now have the opportunity to seek parole due to this new ruling, which Davis fears is sending out the wrong message.

"By them doing that, the rest of these gangbangers and everything they think they can do it and realize 'I'm not going to be in there the rest of my life' and that's going to be their reaction," said Davis.

Davis believes all of the juvenile cases should be looked at individually. According to Davis, Fernandes and Lopes received fair trials and just sentences.

Even if the convicted shooters are awarded a new sentence, Davis hopes he never gets out of jail.

"He's going to shoot my son point-blank range at 2 feet away, I mean think about it, you don't want to let this back into society," said Davis.

Although Gov. Deval Patrick supports this Supreme Court ruling, he made it clear the ruling will require a review by the state parole board to determine what it means for Massachusetts.
