Rape Charges Against Former BU Hockey Player Dropped

BOSTON (CBS) – Rape charges against former Boston University hockey player Max Nicastrohave been dropped.

The charges against Nicastro were dismissed on Friday due to a lack of sufficient evidence.

“After a three-month investigation and a comprehensive review of the evidence it developed, prosecutors determined that they could not meet their burden at trial of proof beyond a reasonable doubt and had an ethical obligation not to pursue it further,” Suffolk County District Attorney spokesperson Jake Wark said.

“They have declined to prosecute Max, and that speaks volumes,” his attorney Hugh Curran said.

Nicastro was obviously pleased with the outcome of the case.

“I feel relieved and just happy it’s done with. It’s been a hard road,” Nicastro said after Friday’s hearing.

Nicastro was arrested on February 19 after a female student accused him of sexually assaulting her.

At the time, authorities said the woman was visibly upset when police arrived, and she was transported to Beth Israel Deaconess Medical Center for treatment.

Nicastro was immediately suspended from the hockey team pending the outcome of the allegations.

Two days after being charged, BU officials said Nicastro was no longer enrolled at the school, although they would not discuss whether any action was taken against him or if he had decided to leave the school on his own accord.

Curran said Nicastro’s focus now will be on getting his degree. He would not say whether Max would apply to be reinstated at Boston University.
