ORLEANS (CBS) – Police have charged a 69-year-old Orleans man with motor vehicle homicide after he allegedly struck a woman with his truck.

Police responded to Finlay Road at 5:00 p.m. and found 47-year-old Diane Cole in the roadway with extensive injuries. She was transported to Cape Cod Hospital where she was pronounced dead.

Witnesses at the scene said they saw a white GMC pickup truck traveling at a slow rate of speed, when the passenger door opened and the woman fell from the truck. The rear wheel of the truck then struck the victim.

Dennis Maskell was arrested at the scene and charged with operating under the influence of alcohol, negligent operation and later motor vehicle homicide. He was released on bail and will appear in court on Monday.

The investigation is ongoing.

    She got out of a moving vehicle and he is being charged with killing her? He will be convicted of the DUI but I don’t see how they can make the other charge stick. How can they prove that she didn’t bang her head when she fell out? Very sad case either way. This womans family can’t bring her back. My heart goes out to them :(

    The woman is the story is my cousin! She “fell” from the truck, he may have pushed her. We don’t know, but you should keep your comments to yourself!!
