State Says Devin Frenette Is In A Safe Place

HAMPSTEAD, N.H. (CBS) - A New Hampshire state agency is now getting involved in the case of a 9-year-old boy who keeps running away from home.

Devin Frenette ran off for the second time in a week on Tuesday and was located in a tree hours later. Last week, hundreds of searchers spent hours looking for the child, who was ultimately discovered hiding under a bed in a neighbor's home.

Devin spent Tuesday night in protective custody.

"What I had one of my detectives do was contact the judge by phone, and the judge ordered that we hold him for 24 hours 'til he could be brought back before a hearing (Wednesday)," said Hampstead Police Lt. John Frazier.

Devin did not come home with his parents following a court hearing Wednesday.

It's unclear where Devin is, but DCYF Director Maggie Bishop says he's in a safe place.

Details of the hearing are confidential, but generally, Bishop says the court decides when a child in protective custody can come home.

Devin is developmentally delayed both mentally and physically.
