Drunk Driving Convictions In '04 Super Bowl Death Thrown Out

BOSTON (AP) -- A Massachusetts appeals court has thrown out the drunken driving convictions of a man who drove into a crowd celebrating the New England Patriots' 2004 championship, killing a 21-year-old man.

Stanley Filoma of Boston was convicted in the death of James Grabowski. Prosecutors said Filoma was drunk and trying to get away from police when he drove his SUV into the crowd. Four other people were injured.

The state Appeals Court on Wednesday upheld Filoma's conviction on involuntary manslaughter and aggravated assault and battery by means of a dangerous weapon. But it reversed his convictions on two counts of operating under the influence and causing serious bodily injury, citing deficient testimony from a prosecution expert.

Filoma testified he panicked when two groups of people attacked his car.
